Privacy Agreement

This is our privacy agreement. Please read and accept this before progressing with our application.

The data controller is Atkins Limited incorporated and registered in England and Wales with company number 688424 whose registered office is at Woodcote Grove, Ashley Road, Epsom, Surrey, KT18 5BW. Amberjack, having offices at Newbury House, 20 Kings Road West, Newbury, Berkshire, RG14 5XR is the data processor.

3. Introduction

Atkins recognises that when you submit an application for employment with us, you have entrusted us with some of your personal information.Atkins is committed to your right to privacy and will make every effort to keep your personal information private. We have therefore developed the Privacy Statement below. We want you to know that we take our responsibilities to store, process and use your information seriously. You will find information here about how we fulfil these responsibilities. Before providing us with any of your details, please read the following important information which concerns the protection of your personal data. The personal data you provide for this application and otherwise as part of the recruitment process, will be held and processed for the sole purpose of supporting the selection and recruitment processes of Atkins.

Please note that this Privacy Statement only applies to information we collect via the Amberjack system. We also collect information elsewhere on our website and you should refer to our general Privacy statement in relation to the handling of such information.

4. Your consent to this privacy statement

By providing your personal information to us, you signify your acceptance of our Privacy Statement and consent to the collection, use and disclosure by us of your personal information as described in this Privacy Statement. If you do not agree to any part of this Privacy Statement, please do not provide us with your personal information. If, once you have provided such information, you wish it to be amended or removed altogether from our systems, please let us know and we will endeavour to comply with your request (see Contacting Us).

5. Information Collection

Atkins will not collect any information about individual applicants, except where it is specifically and knowingly submitted by or on behalf of you. This includes:

  • Contact information (e.g. name, postal address and email address)
  • Academic and vocational qualifications, skills and competencies
  • CV/Resume documents that support your job applications, and any content you include in your application (such as covering letters or emails)
  • Employment history
  • Job application history
  • Your responses to job-specific questions and any psychometric test results
  • Information relating to how you heard about our job opportunities
  • Notes made about your application by the recruitment team during the recruitment process
  • Any correspondence we have with you regarding your application.
  • Sensitive information (Diversity data) if you choose to submit it as part of the application process, and;

It is important that the personal information you provide to us is relevant to the role you are applying for. Please review your application before submitting it to make sure you are not supplying any information which is excessive, or which you do not feel is relevant to our consideration of your application.

We would like you to supply some demographic information which we regard as sensitive personal information. Provision of this information is optional. Choosing not to enter this information will not prejudice you application. Demographic information will only be available to System Administrators and will be anonymised for management information purposes.

In addition to the information you submit directly in your application, we also collect information about the computer you are using to access the site. We cannot use this technical information to identify you personally. This information enables us to provide you with a good experience when using our site. This information includes your Internet Protocol ("IP") address and your domain name. Your IP address is the number that is automatically assigned to your computer by the ISP computer through which you access the internet and your domain name is the name of the ISP computer itself through which you access the internet.

6. Where Your Information is held

The personal information that we hold about you may be transferred to, and stored in, secure databases which are located inside the European Economic Area (EEA).The exact location of those databases may vary. These databases are operated and managed by Amberjack and your information will be shared with Atkins. Where any third party has access to personal information about you, they are required to act in accordance with Atkins' instructions, and we take steps to ensure that they comply with appropriate security standards with regard to your information.

By providing any personal information to us, you are confirming you understand fully and consent to the collection and processing of such information, including, as necessary,the transfer of such personal information to other countries or territories around the world in which we operate. Your consent therefore includes consent to us processing your personal information by transferring it to, and storing it at, a destination outside the European Economic Area. We confirm we will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this Privacy Statement.

7. Use of Your Information

We will hold and process any personal information which you provide via the site or by submitting emails and/or online forms for our own internal business purposes, including lawful purposes relating to recruitment where information is sent by you via the recruitment part of the Amberjack system. We do not pass on or sell personal information to third parties. We may however share such information with affiliates of Atkins.The application information you submit is used for the following purposes:

  • To assess your skills, qualifications and experience against our career opportunities;
  • To verify your information and conduct reference and background checks;
  • To create and submit reports as required by law or regulation;
  • To improve our recruitment process; and
  • Legal defence as necessary

Once we have collected your personal information through the Amberjack system, we may use and/or disclose it in one or more of the following ways:

  1. Informative Communications - to keep you updated on the progress of your application and any action required. You may unsubscribe from any such communications at any time.

  2. Analysis - We may use information you supply for internal recruitment and marketing analysis, for example, to assess trends amongst our potential staff and consumers or to measure the amount of traffic to our careers site. We may also provide this information to certain third party agencies acting on our behalf, for example those who assist us with recruitment or evaluate the effectiveness of our service. We may also share non-personal information with others, such as our service providers and advertisers, in aggregate, anonymous form, which means that the information will not contain any personally identifiable information about you.

  3. Sale or Transfer - In the event of a sale, merger, consolidation, change in control, transfer of substantial assets, financing, reorganisation or liquidation of Atkins, we may transfer or assign to third parties information concerning your relationship with us, including personally identifiable information that you have provided to us.

  4. Legal Purposes - We may collect, use and/or disclose your personal information if permitted by law or required to do so by law or where we believe such action is necessary in order to detect, protect or defend us and/or third parties against error negligence, breach of contract, theft, fraud and other illegal or harmful activity, to comply with our audit and security requirements, and to audit compliance with our corporate policies, procedures, legal and contractual obligations.

8. Storage and Processing of Personal Information

Should your application be successful the information you supply will form part of your personnel file.Whether your application is successful or not, your details will be held within the database for a period of up to 3 years from the submission date for consideration for suitable alternative positions within Atkins.

9. Protection of Your Personal Information

Atkins maintains reasonable administrative, technical and physical safeguards in an effort to protect against unauthorised access, use, modification or disclosure of your Information whilst in its custody and control. Your Information is stored on servers [owned and managed] by Amberjack in its capacity as Atkins' data processor. Atkins will require you to establish a user name and password to access your Information relating to your application. You are responsible for keeping your user name and password confidential and you should not share them with anyone. Atkins will never ask you for your password in any unsolicited communication, such as a letter, phone call or email message. Atkins has retention processes designed to retain Information for no longer than necessary for the purposes described in this Privacy Statement and to comply with applicable legal requirements.Information may be retained for a period of up to 3 years after which time it will be deleted.

10. Use of Cookies

In order to enforce secure access to this site we make use of a cookie which is set after a user has logged in. This cookie contains no readable information and only exists for the length of time that the user is logged into the site. If a site user chooses the option to remain logged into the site, a second cookie is stored which holds the user’s username such that on future visits to the site the user can be automatically logged in.

In addition to disclosures required for the uses identified above, from time to time, and to the extent necessary, we may disclose your personal information to

  • Our service providers and subcontractors, including our affiliates, retained to perform functions on our behalf or to provide services to us in relation to the recruitment process and management of the careers site. These may include data processing; software development; website hosting and management; information technology and office services; legal, accounting, audit and other professional services; and/or
  • Any other third party with your consent or where disclosure is required or permitted by law.

A request should be accompanied by a cheque or postal order for £10.00 (10 GBP) made out to Atkins Limited. This is payment of the administration fee for accessing personal information. The administration fee must be paid by you, the data subject, every time you make a request to access your records and access will only be given once paymenthas been received. Requests must include:

  • Name
  • Relationship to Atkins (e.g. employee, job applicant)
  • If an employee, your staff number
  • Home address
  • Daytime telephone number
  • Where possible, the information you are interested in receiving/viewing

We may require proof of identity from you prior to disclosing such information.

15. Your Rights

By submitting your personal data and application, you

When using our careers site you shall not post or send to or from this website any material

  • For which you have not obtained all necessary consents
  • Which is discriminatory, obscene, pornographic, defamatory or liable to incite hatred
  • In breach of confidentiality or the privacy of others
  • Which may cause annoyance or inconvenience to others
  • Which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or is otherwise contrary to laws in your locale and in the United Kingdom
  • Which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

We will cooperate fully with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this careers site in breach of the above.

We will endeavor to make the Career site available to you 24 hours daily, but technical issues may preclude this. Atkins shall have no liability to you for any interruption or delay in access to this site irrespective of the cause.

Nothing in this Privacy Statement or otherwise will create, or add to, any right or claim (whether legal, equitable or otherwise) that any individual or person may have at law or otherwise against Atkins or any third party or any of their respective directors, officers, employees, agents or representatives; nor will the existence of this Privacy Statement or its application impose or add to any obligations or liability upon Atkins that Atkins does not already otherwise have under law.

We take all reasonable steps to ensure that the information on our careers site or the Amberjack system is correct, however, we do not guarantee the accuracy or completeness of material. Neither we, nor any other party, (whether or not involved in producing maintaining, or delivering our careers site), shall be liable or responsible for any kind of loss or damage that may result to you or any third party as a result of your or their use of this site. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss.

Nothing in these terms shall exclude or limit liability for

  1. Death or personal injury caused by negligence (as defined under the Unfair Contract Terms Act 1997);

Atkins understands the importance of protecting children's privacy, especially in an online environment. This Atkins careers site is not intentionally designed for or directed at children or minors.It is Atkins' policy to never knowingly collect or maintain information about children or minors.

The conditions of use in this Privacy Statement are governed by the laws of England and Wales and you agree that the English courts shall have exclusive jurisdiction in any dispute.
